After the issuance of the K-1 Visa:
- The K1 Visa will be valid for 6 months from the date of issuance and good for only one entry to the United States. Foreign fiancee may enter the United States at any time within this 6-month period. It is recommended that K-2 Visa applicants accompany their parent during the initial trip to the U.S.
- Along with the passport, which will contain the K1 Visa (or K-2) Visa, the foreign fiancee (and a K-2 child of a fiancee will be given a sealed envelope, which is required to give to the immigration officer at the port of entry.
- Prior your fiance's trip to the U.S. we would recommend her to obtain at least two copies of birth certificate with certified translation (if in any language other than English). One copy will be used for the Adjustment of Status and another one may be used as necessary.
- At the port of entry the immigration officer will ask foreign fiancee several questions regarding the purpose of her trip. Please ensure that she/he remembers the ultimate destination.
- Upon arrival to the United States the foreign fiancee will be given 90 days to marry the Petitioner. If the alien fiancee and the Petitioner decide not to marry within the required 90-day period the alien fiancee must leave the United States immediately.
- At the port of entry a white card will be stapled into your fiancee's passport (I94 arrival document). It serves as a legal proof of entry and must remain in the passport at all times.
- Marriage law varies depending on the State of your residence. You will have to check how to obtain a marriage certificate in your State of residence.
- Once married - your spouse will have to obtain US residency. This process is called the Adjustment of Status. The document that certifies the issuance of the US resident status is commonly known as greencard. If the application is not filed for the Adjustment of Status timely, your spouse will be designated for removal proceedings by USCIS.
- Besides the greencard your spouse will need to obtain work and travel authorization. The applications for work and travel authorization must be filed concurrently with the application for the greencard.
- The Government filing fee forthe Adjustment of Status is $1,070.

The issuance of work/travel authorizations: 60-90 days of the initial filing.
The issuance of the greencard: 4-6 months of the initial filing. |
